They apply to your access to and use of the website at gavofund.com, together with any related pages, online forms, applications, email notifications and other services we make available (collectively, the “Services”), and any information, text, graphics, photographs or other materials appearing on the Services (the “Content”).
Your access to and use of the Services signifies your acceptance of these Terms of Use and your agreement to be bound by them. If you do not agree, please do not use the Services.
1. About Us and These Terms
1.1The Services are provided by GAVO Sdn Bhd (Company No. 201201043285), a company incorporated in Malaysia and a licensed moneylender under the Moneylenders Act 1951 (licence no. WL7948/14/01-3/250128) (“GAVO”, “we”, “us” or “our”).
1.2These Terms of Use also incorporate our Privacy Policy, which sets out how we process your personal data. By using the Services, you consent to such processing and warrant that the information you provide is accurate.
2. Eligibility
2.1The Services are available only to individuals who are at least 18 years of age and able to form legally binding contracts under applicable law. If you are under 18, please do not use the Services.
2.2The Services are intended for users in Malaysia. The Services should not be regarded as an offer or solicitation to any person in any jurisdiction where such an offer or solicitation is unlawful.
3. The Services and No Offer
3.1The Services provide information about GAVO and our loan products and, where available, allow you to submit an enquiry or application. Information on the Services is for general reference only.
3.2Nothing on the Services constitutes an offer of credit or a commitment to lend. Any loan is subject to our assessment of your ability to repay, our eligibility criteria, applicable law, and our final approval, which we may grant or refuse at our absolute discretion. Any loan, if approved, will be governed by a separate written loan agreement and by the Moneylenders Act 1951.
3.3Submitting an enquiry or application does not guarantee an offer. We are under no obligation to provide reasons for declining an application.
4. Changes to the Services
4.1The Services are always evolving, and their form, Content and nature may change from time to time without prior notice. We may suspend, withdraw or discontinue all or part of the Services, and we will not be liable if the Services are unavailable at any time or for any period.
5. Reliance on Information
5.1The Content is provided for general information only and is not intended to amount to advice on which you should rely. We make no representation or warranty that the Content is accurate, complete or up to date. You should obtain independent advice before taking, or refraining from, any action on the basis of the Content.
6. Accessing the Services
6.1We do not guarantee that the Services, or any Content, will always be available or uninterrupted. We may suspend, withdraw or restrict the availability of all or part of the Services for business and operational reasons.

7.1If you are provided with log-in credentials, you are responsible for keeping them confidential and for all activities carried out under your account. You must notify us promptly at support@gavofund.com if you know or suspect that any other person has obtained your credentials.
7.2We may disable any user credentials at any time if, in our reasonable opinion, you have failed to comply with these Terms of Use.
8. Your Representations and Warranties
8.1When using the Services, you represent and warrant that:
(a)you have the legal right and capacity to agree to these Terms of Use;
(b)all information you provide is true, accurate, current and complete, and you have not withheld any material fact;
(c)you will promptly notify us if any information you have provided becomes inaccurate or changes; and
(d)your use of the Services will not breach any applicable law or any agreement you have with a third party.
9. Privacy and Credit Checks
9.1Our collection and use of your personal data is governed by our Privacy Policy. By using the Services, you consent to GAVO obtaining and disclosing your credit information from and to credit reporting agencies (including CTOS, Experian and CCRIS) in accordance with the Credit Reporting Agencies Act 2010, as further described in our Privacy Policy.
10. Intellectual Property
10.1All intellectual property rights in the Services and the Content (other than content contributed by users) belong to GAVO or are licensed to us. All rights are reserved.
10.2You may not copy, reproduce, republish, transmit, distribute or create derivative works from any part of the Services without our prior written consent, save that you may view and print pages for your own personal, non-commercial use.
11. Acceptable Use
11.1You must not misuse the Services. In particular, you must not:
(a)use the Services for any unlawful or fraudulent purpose;
(b)submit false, misleading or another person’s information without authority;
(c)introduce any virus, malware or other harmful material, or attempt to gain unauthorised access to the Services; or
(d)interfere with the proper working of the Services or any other user’s use of them.

12.1The Services may contain links to third-party websites and resources. Such links are provided for your convenience only; we have no control over, and accept no responsibility for, the content or availability of those sites. A link does not constitute our endorsement of the linked site.
13. Limitation of Liability and Disclaimers
13.1The Services and the Content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we exclude all representations, warranties and conditions, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.
13.2To the fullest extent permitted by law, GAVO and its directors, employees and agents will not be liable for any indirect, incidental, special or consequential loss or damage, or any loss of profit, goodwill or opportunity, arising out of or in connection with your use of, or inability to use, the Services.
13.3Nothing in these Terms of Use excludes or limits our liability where it would be unlawful to do so. Subject to that, our total aggregate liability arising out of or in connection with the Services shall not exceed RM [liability cap to be confirmed].
14. Indemnity
14.1You agree to indemnify and hold harmless GAVO and its directors, employees and agents from and against any claims, losses, liabilities and expenses (including reasonable legal costs) arising out of your breach of these Terms of Use or your misuse of the Services.
15. Linking to Us
15.1You may link to our Website provided you do so in a way that is fair and legal, does not damage our reputation or take advantage of it, and does not suggest any form of association or endorsement where none exists. We may withdraw linking permission at any time without notice.
16. Severability
16.1If any provision of these Terms of Use is found to be illegal, invalid or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
17. Variations
17.1We may amend these Terms of Use at any time by posting the amended version on our Website. The amended terms take effect from the date of posting. Please check this page from time to time, as your continued use of the Services constitutes acceptance of the amended terms.
18. Waiver
18.1No failure or delay by us in exercising any right or remedy shall operate as a waiver of that or any other right or remedy.
19. Termination
19.1We may suspend or terminate your access to the Services at any time, including if we reasonably believe that you have breached these Terms of Use or created risk or legal exposure for us. Provisions that by their nature should survive termination shall continue to apply.
20. Governing Law and Jurisdiction
20.1These Terms of Use are governed by the laws of Malaysia, and you submit to the exclusive jurisdiction of the courts of Malaysia.
21. Language
21.1These Terms of Use are drafted in the English language, which shall be the governing language. Any notice given under or in connection with these Terms of Use shall be in the English language.
